ORDINANCE 11-01-2012

UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS

AN ORDINANCE OF MONROE CITY, UTAH, ADOPTING THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, ("UCADB") 1997 EDITIONTHE CITY COUNCIL OF MONROE, UTAH HEREBY ORDAINS:

WHEREAS: The UCADB has been approved by the Utah Division of Administrative Rules under R156-56-70;

WHEREAS: The Uniform Code for the Abatement of Dangerous Buildings, 1997 edition, published by the International Conference of Building Officials, 5360 South Workman Mill Road, Whittier, California 90601, is hereby adopted by reference as a primary code of the City of Monroe, to have the same force and effect as though set forth in every particular.

WHEREAS: The purpose of the Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition, is to protect the health and welfare of the residents of the city. The subject matter of this code includes rules and regulations, provides for inspections, and establishes standards for the abatement of unsafe buildings by repair, rehabilitation, demolition, or removal.

WHEREAS: The subject matter of the code includes comprehensive provisions, standards and regulations for materials, installation methods, inspection and other matters relating to the abatement of dangerous buildings, in connection with the erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equipment, use, height, area and maintenance of buildings and structures.

WHEREAS: This code shall apply to all dangerous buildings, as defined in the document adopted in this chapter, which are now in existence or which may hereafter become dangerous within the city. 

WHEREAS: Monroe City has authority to identify, enter, inspect, and abate dangerous buildings and to recover costs for doing so.

If any article, section, paragraph, sentence, clause or phrase of this ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or constitutionality of the remaining portion of this ordinance.

A copy of this ordinance, in its entirety, is available to the public at the City Recorder’s office.

Effective Date.

This ordinance shall become effective immediately after final passage and publication.
